The Legal Lead for Markets, Clearing and Collateral Management reports to the General Counsel – Americas and leads a team of experts in markets, clearing and collateral management. The lawyer will be an expert in financial markets, derivatives, foreign exchange, securities financing, custody, collateral management, clearing and segregation, and will provide strategic legal advice to the General Counsel – Americas on high-risk issues and global initiatives. The lawyer will also influence the company`s strategy with respect to all markets, collateral clearing and management activities, products and services, including government securities clearing, as well as segregation, custody and tripartite collateral management products. The successful candidate will be a highly experienced lawyer, ideally with at least 15 years and over of relevant professional experience in a related role, preferably in the legal department of a company; Previous experience in a law firm is required.
Proven skills and the desire to lead a team of professionals are required, as are strong leadership skills and agility for change. Experience with depositary agreements, audit agreements, security arrangements, as well as MSLA, MRAs, ISDA framework agreements, CSAs and other industry standard trading agreements is an advantage, as is a solid understanding of securities financing agreements, including BNYM`s agency securities lending platform, and experience in custodial and tripartite collateral management agreements. Experience with a broker-dealer focused on sales and trading activities and knowledge of the Dodd-Frank Act, the Commodity Exchanges Act, the Securities Act of 1933, the Stock Exchanges Act of 1934, the CFTC Regulations and the NFA Rules. Knowledge of current regulatory issues impacting the banking and financial services industry, including but not limited to QFC residency rules and ISDA residency protocol, LIBOR transition, etc., is essential.
